These terms and conditions ("the Terms") govern the users ("you" or "your") use of the website www.portagadgets.com ("the Website") and your relationship with Liquidfunds Pte Ltd ("we", "our" or "us"). All products we sell are brand new and original from the manufacturer. Kindly note that all products will be distributed directly from our oversea supplier which explained why we are able to sell the products at a much lower price compared to other online retail shops in Australia. In view of the savings arising from the stocking cost as well as other handling fees, we are able to pass on the savings to you as our customer. Therefore, we wish to inform that we do not keep any stocks at our AU sales office due to the above reason. All orders must be entered via our website only, we do not take orders via phone or email.

When you send an order by means of the On-line store for products and/or services your order shall constitute an offer for the products and/or services selected. We reserve the right to decline any order for any reason, prior to the order being shipped. A contract or agreement for the products and/or services selected shall only be formed once our confirmation message is correctly sent to the address of your electronic mailbox on your Internet access provider's server. All mobile phones are usually delivered via local express courier or fedex in view of the high value item. Our sales team will email customer with a tracking number as soon as the product is shipped. Shipping duration ranges from 3-7 days depending on the location of the customer.

In the event that Fedex or couriers return goods to us as undeliverable for any reason, additional delivery charges may apply to cover the cost of re-delivery. If orders are subsequently cancelled, any refund will have all delivery charges deducted from any refund amount given.

Customer is solely responsible for custom tax and other charges applicable to each shipment.

All merchandise purchased from PortaGadgets.com may be returned within 7 days for a refund or a replacement of the product if the consumer decided otherwise.

All product returns require a RMA#, (Return Merchandise Authorization) and Official Receipts consist of invoice and airwaybill . A RMA number must be issued within 7 days after the date of received; it will be valid for 7 days after it’s issued.

The customer need to bear all related cost of returning the item. The products must be in retail conditions that can be sold as retail merchandise.

Although we have a very flexible return policy on most of the items we sell, there are some exceptions.

The following items may not be returned.
  • Apple ipods
  • Consumables, including but not limited to recordable media, film, digital memory, tapes, batteries, paper, ink, ear phones, pouch, casing.

Refunds (Back to top)

Refunds are applied to the payment method used at the time of purchase 5-10 working days after receipt of the returned merchandise. A full refund cannot be process if there are missing accessories. A refund cannot be process without an official receipt and RMA.

Exchange (Back to top)

If you purchased a product from Portagadgets that you wish to exchange for an alternative, you can return the item for a refund (according to the title - return policy) and simply place a new order for the item you desire. We do not apply a refund credit to your new purchase.

We will send a product replacement after the Return Merchandise Authorisation (RMA) has completed our inspection process. The replacement will ship within 5 working days following our receipt of your return of goods. Please allow additional processing time after Holidays. Although it is our goal to ship a replacement as quickly as possible, we do not send replacements before we receive and inspect the returned merchandise.

Defective items in Transit / Dead on Arrival (Back to top)

An item that was discovered to be defective upon receipt can be replaced , or returned for a full refund. All charges regard to shipping and returning of the item is fully bear by Portagadgets. The reporting of Defective items in Transit or Dead on Arrival must be made within 3 working days / reasonable time frame.

Damaged items (Back to top)

All Packages are inspected for damage before they ship from our warehouse. We must be informed of all shipping related claims within 1 business day after the date of receipt. We do not issue refunds for returns of damaged merchandise. An item that was discovered damaged upon receipt will be replaced with the same model only.

Return shipping (Back to top)

If an item is found faulty and falls under the warranty period, Portagadgets will bear the cost of returning the item back for warranty claims.

If a claim of faulty that does not falls under a manufacturer defects. The customer needs to bear the cost of shipping and associated charges such as cost of replacing the parts and workmanship.

In addition to our standard return policy, customer may requests for Door to Door Premium Pick Up service that will cost from AU$30 onwards to return the product. If the product weight more then 1kg, it will cost more according to the value and weight. Shipping insurance and packaging material are provided upon request from this premier pick up service.

Replacement (Back to top)

We will send a product replacement after the authorized return has completed our receiving/inspection process. The replacement will ship within four business days following our receipt of your return. Please allow additional processing time after Holidays. Although it is our goal to ship a replacement as quickly as possible, we do not send replacements before we receive and inspect the returned merchandise. To receive a replacement more quickly, you may place a new order for the same item (shipping not included), and we will issue a refund for the full value of the returned product (including shipping), upon completion of our return process.

How to Return Merchandise (Back to top)

Please contact us at / for a return authorization number (RMA #). If you do not have the return form, we will provide it to you together with your RMA number. Please fill in the requested information on our product return form, and carefully follow the instructions for return.

Product Condition:

Returned merchandise must be in original condition, and include all factory packed accessories and paperwork (e.g. battery, charger, cords, straps, unmarked warranty card, manuals etc.), in the original manufacturer box and packaging with UPC, barcode, and serial number intact,

Incomplete returns will receive a reduced credit reflecting any missing peripherals / cannot be accepted.

Removal or alteration of a product's UPC number or serial number label will automatically void any possibility of return for credit or replacement. Products that are returned to Portagadgets.com with a missing or altered UPC or serial number will be returned to the sender. Shipping cost will be charge accordingly.

The product serial number must match the serial number in our database (Portagadgets.com maintains serial number tracking).

Your Return Authorization Number must be displayed prominently on the outside of the shipping box.

Remedies:

A consumer has a few options for remedies:

  1. refund in the form of payment made.
  2. replacement of the item / the supply of an equivalent item.
  3. repair of the goods or pay the cost of repair.
Cancellation (Back to top)

Customers can cancel their orders before the delivery of their order. Once the product has been shipped, the customer will bear all the cost of shipment and return. Cancellation of order is subject to return policy terms and condition.

Warranty (Back to top)

All products purchased from this web site are covered by a 12 month limited warranty, in relation to defective materials or workmanship from the date that they are purchased from us, under which your products may be repaired free of charge by sending the product back to us for repair.

For products covered with international warranty, please send to your local service center for repair/replacement by presenting the warranty card to them (this warranty card will be sent together with your shipment).

Kindly refer to warranty page for further details. Please allow up to 30 days for the product to be repaired or replaced.

If you have a complaint about our service, please let us know in writing an email to us at . All complaints will be acknowledged within five working days. We will seek to resolve all complaints within 14 working days and will keep you advised as to what is happening throughout the resolution process.


WARRANTY

Return Policy and Warranty Terms from Portagadgets may be superceded by Australian Competition & Consumer Commission’s Trade Practices Act 1974 if it is unfit and violate the statutory rights between seller and buyer. All products sold through Porta Gadgets comes with a 12 Months Manufacturer Limited Warranty.

Small value items that are below AU$100 may come with a shorter warranty period.

How to get manufacturer limited warranty service? (Back to top)

If you wish to make a claim under the Manufacturer Limited Warranty, you may email us at and provide details of faults or defects. Once your claim of defects is received, we will create an RMA, Fedex Airway bill for the product to be return to the Manufacturer for warranty claims.

When making a Limited Warranty claim you have to present:

  1. The Product

  2. The official receipt from Portagadgets.

The Manufacturer may take a total of 1-2 months to repair and return the defective product.


What is not covered under Manufacturer Limited Warranty? (Back to top)

  1. Free items that does not form part of the sales such as user manuals or any third party software, settings, content, data or links, case and other accessories.
  2. This Limited Warranty does not cover:
    1. Normal wear and tear.
    2. Defects or damage caused by misuse of the Product, including use that is contrary to the instructions provided by The Manufacturer.
    3. Other acts beyond the reasonable control of The Manufacturer.
  3. This Limited Warranty does not apply if the Product has been opened, modified or repaired by anyone other than Portagadgets or instructed by Portagadgets.

For wireless devices such as mobile phone, PDA or any network related devices- A third party, independent operator provides the SIM card and cellular and/or other network or system on which the Product operates. Therefore, the manufacture will not accept responsibility under this warranty for the operation, availability, coverage, services or range of the cellular or other network or system. Before the Product can be repaired or replaced, the operator may need to unlock any SIM-lock or other lock that may have been added to lock the product to a specific network or operator. Accordingly, The Manufacturer does not accept responsibility for any delays in warranty repairs or for the inability of The Manufacturer to complete warranty repairs that are caused by the operator's delay or failure to unlock any SIM-lock or other lock.

Please remember to make back-up copies or keep written records of all important content and data stored in your Product, because content and data may be lost during repair or replacement of the Product. The Manufacturer, in a manner consistent with the provisions of the section entitled "Limitation of The Manufacturer's Liability" below, to the extent permitted by applicable law(s), shall not under any circumstances be liable, either expressly or impliedly, for any damages or losses of any kind whatsoever resulting from loss of, damage to, or corruption of, content or data during repair or replacement of the product.

All parts of the Product or other equipment that The Manufacturer has replaced shall become the property of The Manufacturer. If the returned Product is found not to be covered by the terms and conditions of the Limited Warranty, The Manufacturer and its authorised service companies reserve the right to charge a handling fee. When repairing or replacing the Product, The Manufacturer may use products or parts that are new, equivalent to new or re-conditioned.

Your Product may contain country specific elements, including software. If the Product has been re-exported from its original destination country to another country, the Product may contain country specific elements that are not considered to be a defect under this Limited Warranty.

Limitation of Manufacturer's and Porta Gadgets's liability This Limited Warranty is your sole and exclusive remedy against The Manufacturer and The Manufacturer's sole and exclusive liability in respect of defects in your Product. However, this Limited Warranty shall neither exclude nor limit:

  1. any of your legal (statutory) rights under the applicable national laws or
  2. any of your rights against the seller of the Product.

This Limited Warranty replaces all other Manufacturer warranties and liabilities, whether oral, written, (non-mandatory) statutory, contractual, in tort or otherwise, including, without limitation, and where permitted by applicable law, any implied conditions, warranties or other terms as to satisfactory quality or fitness for purpose. To the extent permitted by applicable law(s) The Manufacturer does not assume any liability for loss of or damage to or corruption of data, for any loss of profit, loss of use of Products or functionality, loss of business, loss of contracts, loss of revenues or loss of anticipated savings, increased costs or expenses or for any indirect loss or damage, consequential loss or damage or special loss or damage. To the extent permitted by applicable law, The Manufacturer's liability shall be limited to the purchase value of the Product. The above limitations shall not apply to death or personal injury resulting from The Manufacturer's proven negligence.

NOTE! Your Product is a sophisticated electronic device. Porta Gadgets strongly encourages you to familiarize yourself with the user guide and instructions provided with and for the Product. Please also note that the Product might contain high precision displays, camera lenses and other such parts, which could be scratched or otherwise damaged if not handled very carefully.


Extended Warranty Policy (Back to top)

1. What is extended warranty? (Back to top)

Extended Warranty is a service offered by Portagadgets Australia at the time of purchasing that extends the Warranty period on selected hardware products up to a total of 4 years.

Extended Warranty provides for the repair or replacement of products if the product fails after the Manufacturer’s Warranty has expired.

The Extended Warranty Plan provides you with additional protection once your existing warranty plan expires. This option can be purchased upon ordering of the products which are not refundable or returnable.


2. Why should I purchase an extended warranty? (Back to top)

There are numerous benefits of extending your warranty:

  1. Total peace of mind where you are not liable for any shipping cost to return your faulty product (applicable to Extended Warranty Plus Options only). No labour cost to bear or even spare parts cost. Normal manufacturer warranty may not cover such minor items that will put a hole on your pocket.

  2. The plan is optional and is available on most products.

  3. Longer coverage period of more then the usual 12 months manufacturer warranty period. The plan provides complete parts and labour coverage with no hidden costs up to a total of 4 years.

  4. Your extended warranty can be claim anywhere in the world. This include even when you are travelling to overseas for a long period of time or you have migrated. As for the normal manufacturer warranty only cover locally.

  5. Guarantee Turnaround Time for return and repair service of not more then 45 days. Otherwise a new replacement will be sent out to you.

3. What is covered under extended warranty? (Back to top)

The Plan does not cover the cost of transport of the product, you can ship back the product to us using your own shipper or you can opt to use our courier company at discounted shipping cost. The shipping cost will be quoted on case to case basis depending on the weight and location of the product.

If we are unable to repair the products due to lack of availability of spare parts during these warranty period, replacement will be made with the same or an equivalent model based on its' current market value at the discretion of Portagadgets Australia. As a general guideline, we will replace you with products value as below:

  • If the products were sent back to us for repair during the first year of purchase, we will replace you with the same product or another product of similar value if we fail to repair the products economically;
  • If the products were sent back to us for repair during the second year of purchase, we will replace you with the same product or another product equivalent to 75% of the product value will be awarded if we fail to repair the products economically;
  • If the products were sent back to us for repair during the third year of purchase, we will replace you with the same product or another product equivalent to 50% of the product value will be awarded if we fail to repair the products economically.

Please note that the above replacement value is served as a general guideline only and we do not guarantee that such value will be honored as the replacement value will be dependable on the market value of the products that you purchased.

The Extended Warranty operates on the same terms & conditions as the Manufacturer's Warranty for the period of the extension. Our warranties generally cover parts and labor costs resulting from a mechanical or electrical failure of the camera caused by defects in workmanship and/or materials. Some parts however, such as the lens and LCD will be excluded. This warranty does not cover equipment which has been misused, tampered with, modified or damaged as a result of accident, water, grit, impact or lack of proper care as indicated in the manual of operations.

  2. Registered Airmail – Small accessories will be shipped using registered airmail if it is not ordered together with the phone or camera.
